Local Regulation of Wireless Antenna Siting

By:  Clarence A. West, Attorney and Counselor at Law

In October 2014, the Federal Communications Commission (FCC) issued an order relating to wireless facility siting in cities.  The order, which preempts many aspects of a city’s ability to regulate the “collocation” of wireless facilities, continues the FCC’s trend of preempting cities.  In the wake of that order, city attorneys need to understand not only the basics of local regulation of wireless antenna siting, but also the impact of federal law and recent FCC orders on that authority.  You can find that information along with a timeline for acting on wireless siting applications by clicking here.
