Preemption: City of New Braunfels v. Stop the Ordinances Please, No. 13-14-00198 in the Third Court of Appeals at Austin. This is an appeal by the City of New Braunfels from a determination that its ordinance banning disposal beverage containers on rivers within the city limits is preempted. The City of Austin, joined by the Texas Municipal League and the Texas City Attorneys Association, argued that the ordinance is not preempted by the state law relating to container packaging. The brief was filed on March 10, 2015.
